General terms and conditions of playing (GTCP):
Playing the MILLIONTIP.COM Lottery is free of charge and does not entail any acquisition of goods or enlisting any charged services. The player is not entering any contractual or other legal obligations vis-à-vis MILLIONTIP.COM or the sponsors or other third parties. Data entered by the user upon registering are treated in full compliance with the German Data Protection Act. Anyone who has reached the age of 18 at the time of playing may play. Legal representatives or employees of MILLIONTIP.COM and their family members are not entitled to play. Nor are persons barred from the lottery by MILLIONTIP.COM allowed to play.
By playing the lottery the player declares that he/she is in agreement with the lottery rules:
1. Registration
Playing the MILLIONTIP.COM lottery requires prior registration in just a few steps. First name, name, address, telephone number, e-mail address and password must be entered for valid registration. MILLIONTIP.COM needs these data to be able to identify the day's winner clearly and notify the winner speedily. The year of birth must also be indicated to guarantee that the player has reached the age of 18. Stating the day and month is optional, although the deciding factor in a borderline case. The player is free to provide other particulars. The player him/herself is responsible for any changes in data and updates associated therewith. The player will have the successful registration confirmed by e-mail.
2. Data protection
The personal data are electronically processed and used considering the binding data protection regulations. The data are stored only as long as it is necessary within this agreement considering the applicable law. The guidelines for processing personal data according to German Data Protection Act are observed. A procedure that differs constitutes the case of winning, for which the participant expressly give the authorisation to publish the participant`s first name, place of residence and a photograph. The player consents to his/her e-mail address, the numbers selected and the reference code to be transmitted to an independent third party for filing and to ensure the due and proper progress of the game. These data will not be put to any other use. These data will be deleted immediately after the following game. The player agrees to his/her personal data transmitted during registration (first name, post code, e-mail address, password, year of birth and other voluntary particulars) being stored and used for internal purposes in studying statistical user behaviour. With acceptance of the data protection regulations the participant agrees with the use of his indications for marketing- and telemarketing purposes and that he receives chosen information from the organiser or autorised contractual partners. The participant can withdraw his acception at any time. He can do this per email to (info@milliontip.com) or per mail to (Gerina AG, Lahncenter, Biegenstr. 4; D-35037 Marburg, Germany). The participation in the lottery remains unaffected from such a revocation.
3. Taking part in the daily draws
MILLIONTIP.COM is based on the popular lotto 6 out of 49 plus additional number, in which numbers are selected from the number board. After selecting all his/her numbers and entering his/her e-mail address and the chosen password, the player confirms his/her selection by clicking on a sponsor's advertising banner he/she has chosen. Each selection is allocated a clearly marked reference code that is stored for the draw. Every registered player who has duly entered a selection that has been received by MILLIONTIP.COM by 2 p.m. (BST) takes part in the daily draw at 3 p.m. (BST) All selections received after 2 p.m. (BST) are automatically entered for the next draw. After entering his/her selection, the player is sent a confirmation e-mail and, once the winning numbers have been ascertained, an e-mail indicating the sponsor and containing a comparison of the player's selected numbers with the winning numbers. This e-mail dispatch can be de-activated in the user's account upon request.
4. Draw procedure
The draw takes place with an officially tested draw device in the presence of an independent, certified security agency that monitors the due and proper progress of the draw and stores the data. The draw is started every day at 3 p.m. (BST) and can be followed live on the Internet on the website of MILLIONTIP.COM. The players whose selected numbers match the numbers drawn are the winners. The main prize for 6 correctly selected numbers + correct additional number amounts to 1,000,000 GBP. The additional number is only relvant in case of 6 correct numbers of 49. I.e. 5 or 6 right numbers are only drawn out of the numerical series from 1 to 49. If there are several winners, the million is divided into equal parts. The prize in case of 6 correctly selected numbers of the numerical series 1 to 49 amounts to 1,000 GBP. The prize in case of 5 correctly selected numbers of the numerical series 1 to 49 amounts to 10 GBP.
From time to time MILLIONTIP.COM will also dispose of special prizes by lot, allocated to players with a smaller number of correctly selected numbers or depending on registrations. This will be publicised by MILLIONTIP.COM on its website in good time.
5. Notifying and ascertaining the winners
After each draw the winning numbers are published on the MILLIONTIP.COM site. In addition, every player receives an e-mail comparing the winning numbers to the numbers selected by the player. The winner(s) receive(s) a separate e-mail informing him/her/them of the prize. The only identification then required is the player's reference code and full address, enabling the player to be notified in writing by registered letter.
6. Payment
The prize will be paid out only to the winner. The winner is required to identify him/herself clearly by presenting his/her identity card or passport. If the winner fails to claim his/her prize from MILLIONTIP.COM within four weeks of the winning numbers having been drawn, the prize is forfeited without being awarded to another winner or to another person. Prizes for 5 or 6 correct numbers are paid off by means of remittance. For the payout of the main prize of 1,000,000 GBP the following arrangement applies: The sum of the prize is paid off in the form of a pension and starts at the 1st day of the month, that follows the prize: The winner receives a monthly amount of 3,333 GBP over a period of 299 months and in the 300th month he receives an amount of 3,433 GBP. A claim for payout in one sum does not exist. The winner him/herself is responsible for any payment of taxes.
7. Disqualification from the lottery
MILLIONTIP.COM is entitled to bar players from the lottery on legitimate grounds, e.g. breach of the Terms and Conditions of Playing, influencing the lottery, manipulating the MILLIONTIP.COM site, etc.
8. Legal action
Legal action is precluded. There is no actionable claim to payment of the prizes.
9.Changes to the playing rules and termination of the lottery
MILLIONTIP.COM reserves the right to change the terms and conditions of the draw at any time. Any change may be made at 2 p.m. (BST) in compliance with the introductory period. Players already registered will be informed of amendments when visiting the MILLIONTIP.COM site. Furthermore, MILLIONTIP.COM reserves the right to terminate or interrupt the lottery at any time. This applies particularly to any reasons that would disrupt or prevent the scheduled course of the lottery.
10. Limitations on liability
MILLIONTIP.COM precludes liability for defective data transfer and/or data loss, unless attributable to errors for which MILLIONTIP.COM is responsible. In particular, MILLIONTIP.COM is not liable in cases in which data are not transmitted or are not transmitted to MILLIONTIP.COM on time owing to a defective and/or incomplete data input by the player. As for the rest, MILLIONTIP.COM is only liable for gross negligence and wilful intent in the event of a breach of fundamental contractual obligations, but not however for any culpable conduct on the part of MILLIONTIP.COM employees. MILLIONTIP.COM precludes liability for indirect loss or damage unless caused by employees with wilful intent or gross negligence. Except in cases of gross negligence / wilful intent on the part of its legal representatives and executives, MILLIONTIP.COM is liable in the limited amount of the loss or damage foreseeable at the time of the conclusion of the contract. MILLIONTIP.COM points out, that in case of placed links MILLIONTIP.COM does not take the responsibility in any case for the contents of the linked site. MILLIONTIP.COM declares, that no influence on the design and content of the linked site is taken. This declaration is valid for all links to foreign web-sites that are placed on the site MILLIONTIP.COM.
11. Severability clause
If a provision of the Terms and Conditions of Playing should be or become invalid, this shall not affect the validity of the remaining provisions. Organisers and players are obliged in such an event to concur in the elaboration of provisions that best approximate the commercial effect of the invalid provision.
12. Applicable law
MILLIONTIP.COM is subject solely to the law of the Federal Republic of Germany. Legal action is precluded.
